On February 15, 2022, FCC Report and Order Declaratory Ruling FCC 22-12 was published detailing new requirements, which directly impacts some Existing and New Service Agreements.
These agreements include among other things, Property Owner “Graduated Revenue Share” compensation arrangements, which are now prohibited under the ruling for some types of properties. The ruling also prohibits Sale and Leaseback Wiring Agreements, Exclusive Revenue Share Agreements, and also requires Exclusive Marketing Agreement Disclosures in marketing materials provided by the Service Providers to residents and prospective residents of communities where Exclusive Marketing Agreements are in place.
